SETTLEMENT VIDEOS

A Settlement Video is a video documentary created for the sole purpose of inducing settlement in civil litigation.  Typically, they are used for personal injury, medical malpractice, product liability, or class action suits.  SVs are highly effective at conveying the extent of an injury, disfigurement, rehabilitation period, financial loss, and other relevant evidence in a multimedia format.

A SV may also be used in business, construction, employment law, or any other litigation where visual evidence is crucial.

SVs have a unique advantage when working towards a settlement: Your message is finely crafted and repeatable every time.  Unlike a paper-based settlement brochure where the reader can “skim through” your demand, video has the unique advantage of being linear in nature.  The viewer simply watches your presentation from start to finish.  There is no turning to the last page just to “get to the bottom line.”  Additionally, it is more than just a document; it is a well organized, persuasive presentation within a professionally produced documentary.

Because the SV is sent to insurance adjusters, in-house counsel, CEOs, and/or defense counsel, it gives the plaintiff the opportunity to communicate directly with the ultimate decision-makers.  When corporate executives get an uncensored look at how their case could play out in trial, a settlement is more easily obtained.  This can be a VERY powerful factor leading to a quicker and more favorable settlement.

Our in-house facility includes professional, broadcast-quality video production equipment.  This includes an Avid, non-linear editing system, which is the television and film industry standard.  In many cases we can “enhance” dark images, create slow-motion clips or even picture-in-picture effects, utilizing new or existing video.  This editing platform allows changes to be made more quickly and easily than previous technologies.  We can also deliver your project on a DVD if requested.  Furthermore, our media department combines the talents of individuals with more than 12 years of experience in multimedia, television production, and project management.  This experience also includes work for several Fortune 500 companies. 

Your case will be assigned to an experienced project producer that will work directly with you through all phases of the production.  The first step is to define and spell out the details of your case, including its strengths and weakness.  This process includes an outline of all relevant facts and an inventory of all physical evidence.  From this discussion, a Definition Document is written that includes a timeline, deliverables, and an estimated budget.

Following your approval of the Definition Document, the scriptwriting phase will start.  The facts of your case are brought together to create a compelling narrative.  This script will serve as the blueprint for the remainder of the project.

After your approval of the final script, the production phase will begin.  Now all the elements of production begin to take shape.  We will use a professional voice talent that is right for your case to ensure that your message is presented effectively.  Any media not yet produced is now created.  This may include new photographs, videotaped interviews, synched depositions, sound files, graphics, and animations.

Once the elements have been assembled, they are edited into a story.  A “rough cut” is created that allows you to gauge the tempo, feel, and selection of shots.  After the rough cut is approved, a “final cut” is created that includes transitions or effects that enhance the final message.
